1) Commitment
At FALLINGO™, we reject the sending of unsolicited email (spam) in any form. All commercial or informational communications are made only based on valid consent, a duly assessed legitimate interest, or an existing contractual relationship, and always with a clear option to unsubscribe immediately and free of charge.

 
2) Scope
This policy applies to:
Communications via email, SMS, WhatsApp/Telegram, automated calls, push notifications, social media messaging, and bots.
Forms, funnels, and lead magnets on fallingo.com and subdomains.
Email/SMS providers, affiliates, partners, ambassadors, and contractors sending messages on behalf of FALLINGO™.

 
3) What do we mean by spam?
It is any unsolicited bulk or individual message sent without a valid legal basis, concealing the sender's identity, lacking an opt-out mechanism, or misleading the recipient about its origin, purpose, or conditions.

 
4) Regulatory Framework
Although we operate globally, our practices seek to align with standards such as (but not limited to):
US: CAN-SPAM Act, TCPA (SMS/calls), FCC/FTC rules.
EU/EEA/UK: GDPR/UK-GDPR, ePrivacy/PECR.
Canada: CASL.
LatAm: local anti-spam and personal data laws (e.g., LFPDPPP Mexico, LGPD Brazil, Habeas Data, etc.).
Note: This policy does not replace legal advice. We adapt processes according to the jurisdictions applicable to the recipient.

 
5) Acceptable Shipping Principles
Consent: We prefer double opt-in (email/SMS confirmation). Consent is specific, informed, and verifiable.
Identification: All communications clearly identify FALLINGO™ and provide contact information.
Transparency: Subject and content accurately reflect the purpose. No deceptive lures are used.
Reasonable Frequency: The promised frequency and topic preferences are respected.
Simple Unsubscribe: Visible, functional, and immediate unsubscribe link or instruction (≤ 2 clicks or "STOP" on SMS/WhatsApp).
Data Protection: Processing in accordance with our Privacy Policy and applicable law.
Proof: We retain evidence of consent, including time, IP address, source, and version of the form.

 
6) Specific Channels and Rules
6.1 Email
Required: Identifiable from, physical address or representative, and unsubscribe link.
Techniques: SPF, DKIM, DMARC in p=quarantine or p=reject; list-id; bounce handling (hard/soft).
Content: No guaranteed financial claims; include risk disclaimer where applicable.
6.2 SMS/WhatsApp/Telegram
Onboarding: Explicit opt-in (checkbox + consent text).
Unsubscribe: Keywords: STOP, UNSUBSCRIBE, EXIT; automatic unsubscribe confirmation.
Schedule: We avoid nighttime sending depending on the recipient's time zone.
6.3 Web/App Push
Requires browser/system permission. Easy revocation in user settings.
6.4 Automated Calls
Only with prior consent and evidence recording; always with the option to opt out.
6.5 Social Media Messaging
No bulk sending without prior permission. We respect platform rules.

 
7) Collection and Use of Contact Data
Allowed
Forms on fallingo.com (double opt-in recommended).
Purchases/contracts and existing customer relationships.
Events/webinars where the user agrees to communications.
Prohibited
Purchasing, renting, or scraping databases.
Adding contacts without evidence of consent.
Copying partner lists without agreement and documentary proof.

 
8) Affiliates, Partners, and Ambassadors
Must sign the Anti-Spam Addendum and submit creatives for prior approval.
Use of templates with mandatory fields (ID, unsubscribe, trackable domain).
Prohibited: Cloaking, deceptive rotation, unauthorized forwarding, hidden incentives.
Audits: We may request sending logs and opt-in evidence.
Sanctions: Immediate suspension, withholding of commissions, and termination for cause.

 
9) Strictly Prohibited Practices Identity concealment or header forgery.
Deceptive subject lines or promises of guaranteed profits. Sending to acquired or scraped lists. Lack of an unsubscribe mechanism or ignoring unsubscribe requests. Sending after unsubscribing or to domains on suppression lists.

10) Technical and Operational Measures Double opt-in by default for newsletters.
List hygiene: removal of inactive/bounces, deduplication, validation. Feedback loops with ISPs (complaints < 0.1%). IP/domain throttling and warming. Respectful tracking (UTM, no invasive pixelation). CAPTCHA and limiting submissions from forms. Content reviews: financial risk disclaimers and links to Terms/Privacy.

11) Consent and Preference Management Preference Center:
topics, frequency, channel. Logging: date/time, IP, user agent, opt-in source, legal copy version, and confirmation tests. Evidence Retention: minimum [X] years or as required by applicable law.

12) Subscription and Unsubscription:
Sample Texts Subscription (checkbox next to the submit button): "I authorize FALLINGO™ to send me informational and commercial communications about trading and investment. I can unsubscribe at any time." Email Footer (required): "You received this message because you subscribed to fallingo.com or are a FALLINGO™ customer. To stop receiving emails, click Unsubscribe or reply with UNSUBSCRIBE." SMS/WhatsApp: "FALLINGO™: tips/alerts. Reply STOP to cancel."

13) How to Report Abuse (Complaints Procedure)
If you receive a message that you consider spam on behalf of FALLINGO™, please forward it to abuse@fallingo.com with: A screenshot of the entire message (including headers or metadata, where possible). Receiving address/channel and date/time.

Any additional information (form where you did not provide consent, etc.).

Response SLA: We acknowledge receipt within 48 business hours; investigation and resolution within 10 business days (blocking, deletion, sanctioning the sender, if applicable).

14) Internal Complaint Response (Flow) Registration in the complaints system.
Preventive blocking of the sender/campaign. Verification of consents and logs. Determination and corrective actions. Communication of the outcome to the complainant. Review of controls to prevent recurrence.

15) Sanctions Internal: warning, suspension of shipments, disciplinary measures. Affiliates/Partners: account cancellation, loss of commissions, and claims for damages, if applicable. Report to providers/ISPs/platforms when applicable.

16) Policy Updates We may modify this policy to reflect legal or operational changes.
We will post the current version on fallingo.com with the update date. Material changes may be notified by email.
